The legal Status of Hijab and Niqab under Nigerian legal system.
The legal status quo on hijab and niqab under Nigerian law,is it constitutional rights or ordinary custom of a given tribe (North)??
Legally speaking,No limitation to the right to use hijab or niqab in Nigeria, subject to the provision of section 38(1)of constitution of federal republic of Nigeria (CFRN).
It was clearly stated that"Every person shall be entitled to freedom of thought, conscience and religion, including freedom to change his religion or belief , and freedom (either alone or in community with others and in public or private)to manifest and propagate his religion or belief in worship, teaching, practice and observance".
Conspicuously, this provision gave a room for everybody to practice his or her religion and manifest the teaching of such religion.
Unequivocally,the fundamental teaching of Islam is that hijab is compulsory Q 24 :31,whereas there are some different opinions on the obligatory of niqab.but it suffice to say that,if any sister believes the use of niqab as obligatory,she is still under the cited provision 38(1)CFRN.
In conclusion,hijab is part of our religion likewise niqab and we are free to manifest the teaching of our religion .
